Welcome to DigiSevak, operated by AI Sanchaya. By accessing or using our website, tenant dashboard, or any DigiSevak services (including AI chatbots, avatars, and related features), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

1. Acceptance and Eligibility

By creating an account or using DigiSevak, you confirm that you are at least 18 years old and have the authority to bind yourself or your business to these terms. You must provide accurate and complete registration information and keep it up to date.

2. Description of Services

DigiSevak provides:

• Plug-in Avatars: Interactive virtual assistants that can be embedded on your website with custom scripts and optional voiceovers.
• Plug-in Chatbots: AI-powered conversational agents (Basic and Enhanced plans) with features such as data collection, branching workflows, and appointment scheduling (where applicable).
• Tenant dashboard: Tools to manage avatar scripts, chat flows, analytics, and appointment settings.
• Landing pages (add-on): Optional static web pages hosted on our subdomains (e.g., mybiz.aisanchaya.com, myshop.aisanchaya.com).

Service availability and features may vary by plan and region. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice where practicable.

3. Account and Subscription

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Subscription plans (e.g., Avatar, Chatbot Basic, Chatbot Enhanced) are billed monthly or as otherwise stated. One-time setup costs (e.g., Rs. 800 inclusive of 18% GST) and add-ons (e.g., landing page at Rs. 500) are as displayed at the time of purchase. Prices are in Indian Rupees unless otherwise indicated. Failure to pay may result in suspension or termination of service.

4. Acceptable Use

You agree not to:

• Use the service for any illegal purpose or in violation of any applicable laws.
• Upload, transmit, or promote content that is defamatory, harassing, obscene, or infringes others’ intellectual property or privacy.
• Attempt to gain unauthorised access to our systems, other users’ accounts, or third-party systems.
• Resell, sublicense, or redistribute the service in a manner not permitted by us.
• Use the service to send spam, malware, or to harm or overload our infrastructure.

We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a risk to the service or others.

5. Your Content and Data

You retain ownership of content you upload (e.g., photos for avatars, scripts, business information). You grant us a licence to use, host, and process this content as necessary to provide and improve the service. You are responsible for ensuring you have the rights to use any content you provide and for complying with data protection laws regarding end-user data you collect through our chatbots or avatars. Our handling of personal data is described in our Privacy Policy.

6. Intellectual Property

DigiSevak, AI Sanchaya, our logos, and the technology underlying our platform are owned by us or our licensors. You may not copy, modify, or create derivative works of our software or branding except as expressly permitted (e.g., embedding our provided script on your site).

7. Disclaimers

The service is provided “as is” and “as available”. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. AI-generated responses and avatar behaviour are not guaranteed to be accurate or appropriate for every context; you are responsible for reviewing and configuring your flows and content.

8. Limitation of Liability

To the maximum extent permitted by law, AI Sanchaya and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunity, arising from your use of or inability to use the service. Our total liability for any claims arising from these terms or the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless AI Sanchaya and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your content, your violation of these terms, or your violation of any third-party rights.

10. Termination

You may stop using the service at any time. We may suspend or terminate your account or access if you breach these terms or for other operational or legal reasons. Upon termination, your right to use the service ceases. Provisions that by their nature should survive (e.g., disclaimers, limitation of liability, indemnity) will remain in effect.

11. Governing Law and Disputes

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India. If any provision is found unenforceable, the remaining provisions will remain in full force.

12. Changes to the Terms

We may update these Terms of Service from time to time. We will post the revised terms on this page and update the “Last updated” date. Your continued use of the service after changes constitutes acceptance. If you do not agree, you must stop using the service.
